Terms of Service

1. Acceptance of Terms

By accessing or using the Medolane AI Patient Intake Assistant platform ("Service") provided by Magebytes Technologies ("Company"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. Service Description

Medolane is a SaaS platform that provides an AI-powered patient intake assistant via an embeddable chat widget. The Service helps clinics triage patient concerns, request appointment bookings, and take medication refill requests, handing each off to clinic staff for review and confirmation.

3. Accounts and Registration

• You must provide accurate and complete registration information.
• You are responsible for maintaining the security of your account credentials.
• You must notify us immediately of any unauthorised use of your account.
• Each account may only be used by a single clinic or business entity. Reselling or sub-licensing access is prohibited without our prior written consent.

• Subscriptions are billed monthly in advance.
• Billing is processed through Stripe.
• Unused message quota does not roll over between billing periods.
• We reserve the right to suspend the Service if payment is not received within 7 days of the due date.

5. Acceptable Use

You agree not to use the Service to:

• Transmit spam, phishing messages, or unsolicited commercial communications
• Distribute malware or engage in any activity that disrupts the Service
• Impersonate any person or entity or misrepresent your affiliation
• Collect personal or health-related data from patients beyond what is disclosed in this Privacy Policy
• Violate any applicable laws or regulations, including consumer protection and data privacy laws
• Reverse-engineer or attempt to extract the underlying AI models or source code

6. Intellectual Property

The Medolane platform, including the widget, dashboard, and API, is owned by Magebytes Technologies and protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service during your subscription. You retain all ownership rights to your clinic data and conversation content.

7. AI-Generated Content

The Medolane widget generates responses using large language models, including suggesting which specialty or department a patient's described concern may relate to. This is informational triage support only — it is not a medical diagnosis, and it is not a substitute for professional medical advice, diagnosis, or treatment. Appointment and refill requests submitted through the widget are handed off to clinic staff for clinical review and are not confirmed until your clinic accepts them. We are not liable for any care decisions made based on AI-generated responses.

8. Limitation of Liability

To the maximum extent permitted by law, Magebytes Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill. Our total liability for any claim arising under these Terms shall not exceed the fees paid by you in the three months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Magebytes Technologies and its officers, directors, employees, and agents from any claims, losses, or damages arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

10. Termination

Either party may terminate the subscription at any time. Upon termination, your access to the Service will cease at the end of the current billing period. We reserve the right to suspend or terminate accounts that violate these Terms immediately and without notice.

11. Changes to Terms

We may update these Terms at any time. We will provide at least 14 days' notice of material changes via email. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of the jurisdiction in which Magebytes Technologies is incorporated. Any disputes shall be resolved through binding arbitration, except where prohibited by applicable law.
